Terms and Conditions of Sale<\/h1>

By placing an order, the buyer acknowledges that they have read and agree to these terms and conditions.<\/p>

In the event that certain provisions of these terms and conditions are expressly waived by agreement, the remaining provisions shall remain in effect between the parties<\/p>

The price<\/strong><\/p>

Our prices include all taxes and are billed based on the company\u2019s price list in effect on the date of shipment or shipments, taking into account the applicable shipping rates and duties on that date.<\/p>

For exports, since invoices are exempt from VAT, they will be issued excluding tax. Payments are to be made payable to La Truffe du Ventoux.<\/p>

Failure to pay invoices by the agreed-upon due date will result in, following formal notice, and without prejudice to any potential damages.<\/p>

La Truffe du Ventoux reserves the right to change its pricing schedule. This change will take effect within one month of the publication of the new rates.<\/p>

      Validation<\/strong><\/p>

      You hereby declare that you have read and accepted these General Terms and Conditions of Sale prior to placing your order. By confirming your order, you therefore accept these General Terms and Conditions of Sale.<\/p>

      Products<\/strong><\/p>

      Our product offerings and prices are valid while supplies last. The weight listed for truffles in jars is the weight at the time of packaging; because of the cooking method used, we cannot guarantee a specific drained net weight. The stated weight of fresh truffles is the weight calculated at the time of packaging. However, the buyer should be aware that, as a fresh mushroom, truffles may lose up to 4% of their weight per day in transit. The carrier\u2019s stamp will serve as proof of the pickup date.<\/p>

      Delivery<\/strong><\/p>

      We ship to most European countries and a few international destinations. Fresh truffles must be shipped via express delivery (24 hours) to ensure their freshness. These express packages are shipped with tracking via DHL, TNT, or Chronopost. As for our other products, we ship them via Colissimo (2 to 5 business days).<\/p>

      The customer must be present at the delivery address when the carrier arrives. If this is not possible, there are two options:<\/strong><\/p>

      • Provide an address where you are certain there will be someone available to receive the package (building superintendent, friends, neighbor, workplace, etc.). It is important to provide as much information as possible.<\/li>
      • If the carrier arrives at the delivery address and no one is there to receive the package, the carrier will contact the recipient to schedule a new delivery or drop off the package at a nearby pickup location. Express deliveries are made Tuesday through Friday. Deliveries may also be made as late as Saturday morning. Any order placed before 2:00 p.m. between Monday and Thursday will arrive the next business day. (Example: An order placed on Monday before 2:00 p.m. will be delivered on Tuesday.)<\/li><\/ul>

        Shipping Options for Individuals<\/strong><\/p>

        • Fresh truffle:
          • In France: \u20ac26 (24-hour express shipping)<\/li>
          • Europe: starting at \u20ac35 (1 to 2 days, depending on the country)<\/li><\/ul><\/li>
          • Black Truffle Products: Shipping via Colissimo (3 to 5 business days)
            • In France: \u20ac9.96<\/li>
            • Europe Region: \u20ac17.96<\/li><\/ul><\/li><\/ul>

              These delivery times agreed upon by the company may be extended due to unforeseen events (labor strikes, traffic disruptions, etc.).               Purchases to be picked up at the estate<\/strong><\/p>

              All purchases must be picked up by the buyer or a third party, who must present the order confirmation, within one week of the purchase made on the website. This is because truffle prices fluctuate weekly. Click this link to view our hours of operation.<\/p>

              If the buyer decides to pick up their order the week after making the online purchase\u2014that is, S+1\u2014the seller will require an additional payment to account for changes in the price of truffles, which fluctuates weekly.<\/p>

              Payment<\/strong><\/p>

              Payment for your online purchases can be made by credit card only (Carte Bleue, Visa, or MasterCard; online payments are secure).<\/p>

              For all other orders placed through other channels, payment can be made by:<\/p>

              • Bank check<\/strong> Make the check payable to \u201cLa Truffe du Ventoux\u201d and mail it to the following address: La Truffe du Ventoux, 634 Chemin du Traversier, 84170 MONTEUX. Your order will not be processed until we receive your payment, and the applicable delivery times are those in effect on the date we receive the check.<\/li><\/ul>

                The products remain the property of La Truffe du Ventoux until full payment has been made.<\/p>

                In the event of late payment in commercial transactions, the Law of March 22, 2012, on the Simplification of the Law establishes, effective January 1, 2013, a lump-sum compensation for collection costs. In addition to the late payment penalties automatically due, the creditor may claim this lump-sum compensation, the amount of which is set by decree at \u20ac40.<\/p>

                Right of Withdrawal<\/strong><\/p>

                You have a 14-day right of withdrawal from the date of receipt, as provided by law, to return items to us without having to provide a reason. You will be responsible for the return shipping costs, and only the price of the purchased product(s) will be refunded. Products must be returned in their original condition and accompanied by a copy of the invoice. Items returned incomplete, damaged, or soiled by the customer will not be accepted. The right of withdrawal does not apply to fresh truffles.<\/p>

                Defect <\/strong><\/p>

                If a product is defective, we will replace it. We may cover the return shipping costs upon request. Under no circumstances will the amount we cover exceed the original shipping charges. Simply contact us within 72 hours and return the package via certified mail with return receipt requested.<\/p>

                Liability <\/strong><\/p>

                The products offered comply with current French law. La Truffe du Ventoux cannot be held liable for any failure to comply with the laws of the country to which the products are shipped. It is your responsibility to check with local authorities regarding the importation or use of the products you intend to order. Please refer to each product\u2019s description for specific details. Feel free to contact us if you have any questions or would like additional information.<\/p>

                Protection<\/strong><\/p>

                The content on this website, including but not limited to text, illustrations, and photographs, may not be used, modified, altered, reproduced in whole or in part, or otherwise exploited in any way without the express consent of La Truffe du Ventoux.<\/p>

                Disputes <\/strong><\/p>

                This contract is governed by French law. The language of this contract is French. Any dispute shall fall under the exclusive jurisdiction of the Commercial Court, which shall have sole jurisdiction, regardless of the place of shipment.<\/p>
